Real Estate Issues Involving Bankruptcy

The intersection of bankruptcy and real estate can create some interesting legal issues; read - and hear - more about these issues in this post

I have been involved with the Real Estate Radio Hour since 2008. The show, co-hosted by Chris Rooney of The Realty House and Andy Prasky of Re/Max Real Estate Properties, discusses any and all topics relating to real estate, often with guests. Advice to buyers and sellers, current market trends and much more, make this show a must listen for anyone interested in the real estate marketplace.I am featured weekly in a segment called the "Legal Minute."

One of the trickiest areas of real estate law involves the intersection of real estate and bankruptcy law.  When someone files bankruptcy, what happens to the real estate they own?  What is the effect on recently completed transactions or pending transactions?  What can a creditor do if a debtor has taken steps to shield real estate assets from creditors prior to a bankruptcy?

These are some of the issues we address in the Legal Minute segments for the entire month of November and the first week of December.  Special thanks are in order to my colleague Margie Bodas who provided the information for these segments.  In addition to her role as Lommen Abdo's Vice President of Practice Management, Margie focuses her practice on issues such as creditors remedies including bankruptcy preference litigation.  You can read more about our credtitors remedies practice on the Lommen Abdo website.
