Court Appoints Emergency Conservator for Man Accused of Killing Albertville Teacher
Looking to get legal proceedings against 81-year-old Delbert Huber moving again, a Kandiyohi County Court judge has a local attorney to review the accused gunman's assets.
Kandiyohi County District Court Judge Michael J. Thompson appointed an emergency conservator to 81-year-old Delbert Huber Tuesday, in hopes of getting the legal proceedings against the man accused of shooting Timothy Larson, 43, of Albertville, moving once again.
Huber, who has been indicted by a grand jury on charges of first degree murder in the Oct. 8 shooting death of the respected teacher, has not been able to retain an attorney in the case up to this point, because his net assets don't allow him to hire a public defender, but he hasn't been able to get a loan to retain local legal representation to this point.
The conservator, named as Thomas Jones of Willmar law firm Jones and Patck according to the West Central Tribune, will review and invetory Huber's assets, help arrange the rentention of a local attorney, pay for items per court request and appear at a Dec. 22 hearing Thompson scheduled Tuesday afternoon.

Huber's niece, Cherry DeMarais, who lives in Howard Lake, had been working to hire a local attorney but , which is valued in the hundreds of thousands of dollars. DeMarais also said she was working with her aunt, Elise Wagner, of Sioux Falls, S.D. Wagner is Huber's sister.
Huber and his son, Timothy, have been held on bail since the day they were charged in Larson's murder. According to arrest documents and court proceedings, the elder Huber is accused of shooting Larson the morning of Oct. 8, then waiting 12 hours to report the incident to the local sheriff's department.

through his attorneys to plead he was under mental duress at the time of the shooting. In a hearing on Dec. 7, Judge Donald M. Spilseth ordered a mental evaluation for Timothy Huber, to be performed by Dr. Edmund Nadolny. That report will be filed with the court.
Delbert Huber is being held on $5 million bail, while Timothy Huber's bail is set at $1 million.
The sentence for murder in the first degree-premiditated is life imprisonment.
