Family of St. Michael-Albertville Teacher Files Lawsuit Against Suspects

The family of 45-year-old Timothy Larson has filed a wrongful death lawsuit against Delbert Huber and his family in Wright County District Court.

A lawsuit has been filed in Wright County District Court against the two men charged with the first-degree, premeditated murder of special education teacher Timothy Larson.

Larson's family, including his wife, Debra, filed the suit last month, after a series of hearings showed the Delbert Huber, 81, the man accused of shooting and Killing Tim in cold blood, had more than 170 acres of land between Stearns and Kandiyohi County.

The suit, according to attorney Ryan Vettelson, was necessary as the Kandiyohi County court continues to work with Huber on matters of legal representation.

Huber's son, also named Timothy, is named in the suit as well.

Two judges have determined the elder Huber is not eligible for a public defender . Timothy Huber is undergoing mental evaluation to see if his is fit to stand trial. A report should be in the court's hands later this year. He does qualify for public defense.

The wrongful death suit assures the court, and the Larson family, will be consulted before any sale or "quitclaim" deeds can be filed on the land. Two were already filed last November, moving land assets into the control of Delbert Huber's sister and niece.

Vettelson told the West Central Tribune Thursday that ""It looks like he is moving assets," Vettelson said. "We want to try to preserve and recover as many of his assets as we can for the family of the victim."

Huber is working with two family members to also allocate funds for private counsel. The Larson suit against the Hubers was amended prior to the end of 2011 to list those two family members in the suit, as well.

According to arrest records filed in Kandiyohi County, the Delbert Huber shot Timothy Larson with a high-powered rifle after an argument the previous night. Timothy Huber drove Delbert Huber to Larson's father's land on the morning of Oct. 7 with the intent of killing him,. Delbert Huber left Larson dead on the property for 12 hours before returning later that day and calling authorities, telling them he shot a man.

Larson, a beloved teacher in the community, died instantly. He leaves behind his wife, two sons, his parents and several siblings.

The wrongful death suit has had one hearing, granting the Huber family a continuance while he is prosecuted on criminal charges.

No further hearings have been scheduled in Wright County. Judge Jonathan Jasper is overseeing the case.
