Father's Trial in St. Michael Teacher Shooting Delayed Again

Delbert Huber is still struggling to find a way for legal representation, and was granted more time to make arrangements before making his initial appearance on murder charges.

The man charged in a rural Kandiyohi County murder is trying to free up money from his estate to hire a defense attorney, and again asked for a continuance in Kandiyohi County District Court Monday.

As a result, the trial accusing him of killing St. Michael-Albertville teacher Timothy Larson has been delayed again, according to the West Central Tribune.

Kandiyohi County Attorney Jennifer Fischer again did not object to the delay, the second so far in this trial.

Huber, who is charged with second degree murder, represented himself at this appearance, but told judge Huber told Judge Kathryn N. Smith that "the person holding his power of attorney has been unable to locate the deed to his property, which would allow him to borrow money against the property to secure an attorney," according to the Tribune report, filed Tuesday morning.

Huber's son, Timothy, made his Rule 8 hearing Monday, Oct 24. Both parties explained they understood the charges against Timothy Huber, including aiding and abetting his father in the murder of Tim Larson, and being an accomplice after the fact.

Those charges carry a maximum sentence of 40 years in jail, equivalent to second degree murder.

Tim Huber's omnibus hearing has been set for Dec. 16 in Willmar.

Delbert Huber's omnibus hearing was scheduled for Dec. 28, but will ultimately be delayed.

Both men are being held in the county jail. Delbert Huber is held on $5 million bail, while Timothy Huber's is set at $1 million.
