Judge Sets Omnibus Hearing for Suspect in Albertville Teacher Murder

After delaying legal proceedings for more than a month, Delbert Huber, the 81-year-old charged with first degree murder in the shooting death of Timothy Larson, will have his omnibus hearing in January.

After all that, the trial must proceed. 

That's was the declaration of a Kandiyohi County Judge last week, as Judge Michael T. Thompson declared a date for the omnibus hearing for Delbert Huber, the man accused of shooting St. Michael-Albertville Middle School teacher Timothy Larson last October. 

According to an article filed last week in the West Central Tribune, Huber's financial status is no longer an issue, and the trial will proceed with or without his procurement of representation.

Seemingly having reached his limit with Huber's financial issues–his wealth (land investment) precludes him from using a public defender, but he doesn't have cash on hand to hire a local defense attorney–Thompson set the date for Jan. 23 in Willmar. 

“It is the court’s decision that Mr. Huber does have the ability to procure private counsel,” the Tribune said Thompson announced after reopening a hearing alst week to the media and public. “Whether he does so is his decision.”

Last week's hearing, held on Friday, Dec. 23, was the sixth hearing where Huber appeared without representation. 

Huber and his son, Timothy, have been held on bail since the day they were charged in Larson's murder. According to arrest documents and court proceedings, the elder Huber is accused of shooting Larson the morning of Oct. 8, then waiting 12 hours to report the incident to the local sheriff's department. 

 through his attorneys to plead he was under mental duress at the time of the shooting. In a hearing on Dec. 7, Judge Donald M. Spilseth ordered a mental evaluation for Timothy Huber, to be performed by Dr. Edmund Nadolny. That report will be filed with the court. 

Delbert Huber is being held on $5 million bail, while Timothy Huber's bail is set at $1 million. 

The sentence for murder in the first degree-premiditated is life imprisonment.
