Trial for Man Accused in Albertville Teacher's Murder Set for June

Despite his troubles procuring an attorney thus far, Delbert Huber will be in court for his jury trial in June.

A Kandiyohi County Judge has filed a scheduling order in district courtsetting a trial date for June 18 for Delbert Edwin Huber, the 81-year-old man charged with shooting and killing an Albertville teacher back in October.

District Judge Michael J. thompson filed the paperwork to set the 10-day jury trail to begin that date, with jury selection. Additional hearings already scheduled will resume April 12, when Huber is expected to make his next court appearance.

Delbert Huber is being held in Kandiyohi County jail on $5 million bail. He is charged in the first-degree murder of Timothy Larson, 43, a special education teacher at .

A grand jury indicted Huber and his son, Timothy John Huber, 45, on first-degree charges. The two men also face second-degree intentional murder charges for the Oct. 8 shooting of Larson on his father's farm near Willmar.

The elder Huber has appeared seven times in district court without legal represenation, and has been granted several stays while he attempts to arrange his legal representation and finances within a trust operated by his sister and niece.

The Larson family filed a civil suit in December accusing the Hubers of wrongful death, in a move to obtain monetary damages before the Huber estate could be moved into any form of protection.

Both Hubers have been jailed since the evening of the shooting, some 12 hours after Larson was gunned down. Delbert Huber called police and admitted to firing a British rifle at Larson, killing him, according to police records.

Timothy Huber is being held on $1 million bail. He has filed paperwork to plead mental illness or duress at the time of the shooting, following a motion in December. A mental evaluation was ordered by the court Dec. 7.

A trail date for Tim Huber has not been set by the court at this time, pending the evalution.
