Trial Starts for Tim Huber, Charged with Murder in Death of Tim Larson of Albertville

Jury selection is the first order of business in a trial set to last three weeks.

Timothy Huber's trial begins this week in Willmar, news organizations report, on charges that he played a role in killing Albertville resident Tim Larson.

KDUZ summarized the case against Huber:

The 47-year-old Huber, of rural Paynesville, is charged with 1 count of 1st Degree and 2 counts of 2nd Degree Murder for his part in the October 8th 2011 shooting death of 43-year-old Tim Larson of Albertville at Larson’s father’s farm in Burbank Township. ... Last August, 82-year-old Delbert Huber, admitted shooting Larson and pleaded guilty to 2nd Degree Murder and was sentenced to 30 years in prison.

At Tim Huber’s pre-trial hearing last week attorneys on both sides went through procedural issues before [Kandiyohi County District] Judge Don Spilseth, such as the list of witnesses both sides plan to call, and what questions can or can’t be asked of potential jurors during jury selection. The Kandiyohi County Attorney’s Office has asked Spilseth not to allow Delbert Huber’s VA Medical records to be allowed as evidence, as well as Tim Huber’s Paynesville High School and St. Cloud medical records. They argue those records would be irrelevent in helping prove Huber’s innocence or guilt on the murder charges. The state is trying to prove Tim Huber knew his father was going to shoot Larson or even encouraged him to do so.

The West Central Tribune reported that over the course of two days, all the  jurors had been selected:

The 14 jurors, including the 12 required jurors plus two alternates, were selected by 3 p.m. Tuesday. The attorneys will give their opening arguments and testimony will begin on Thursday morning before District Judge Donald M. Spilseth. ... The court had previously expected that the selection process could take most or all of this week, with the following two weeks, through May 10, scheduled for the trial.

During his August plea hearing in the case, Delbert Huber admitted that he pointed a loaded 303 British Enfield rifle at Larson and pulled the trigger during the confrontation. He claimed during his sentencing hearing in September that his son had nothing to do with the shooting and that Timothy Huber was doing farm chores when the killing occurred.
