UPDATE: Two Accused in St. Michael-Albertville Teacher's Murder to Make Court Appearance

Both men arrested in the shooting death of Timothy A. Larson are schedule to appear for Rule 8 hearings this afternoon in Willmar.

UPDATE (3 p.m.) – According to court records, Delbert Huber is choosing to represent himslef for today's hearing in front of a Kandiyohi District Court judge.

His son, Timothy, has been assigned a public defender to assist his case.

The two men charged in the shooting of St. Michael-Albertville teacher Timothy A. Larson will appear in Kandiyohi County court today, their initial appearance on charges of second degree murder.

Delbert Huber, 81, of rural Paynesville, will make his Rule 8 appearance on charges of second degree murder–with intent, not premiditated, in Willmar today.

His son, Timothy, John Huber, 45, will face liability charges for murder in the second degree, not premeditated, as well as charges for being an accomplice after the fact.

Kandiyohi County Attorney Jennifer Fischer has not moved forward with a grand jury investigation at this time, which could up those charges to first degree murder–with intent, premeditated.

A Rule 8 hearing following the arraignment at which the attorney appears with the defendant, where the conditions of release might be reviewed, and where the defense attorney usually requests either an omnibus hearing or a trial date.

Fischer has requested a Dec. 16 omnibus hearing for Timothy Huber, and a Dec. 28 ominubs hearing for Dec. 28.

The two men were arrested Saturday, Oct. 8, after Delbert Huber called 911 to tell a dispatcher that he had shot and killed a man on the property of Norman Larson, east of Willmar.

According to the criminal complaint, Delbert Huber made that call nearly 12 hours after he had allegedly shot and killed Timothy Larson with a rifle at close range.

The two men left the property, the complaint states, after an altercation that morning that led to the shooting, and then returned that night to place the 911 call.

Timothy A. Larson, 43, was a beloved special education teacher at St. Michael-Albertville Middle School West. He leaves behind a wife and two sons.
