Mental Evaluation Complete for Accomplice in St. Michael Teacher’s Death

The evaluation of Timothy Huber, the accomplice charged with first-degree murder in the death of a St. Michael-Albertville teacher, has been filed with the court. Attorneys will have 10 days to file any objections to those findings.

With his father awaiting a June trial date, Timothy Huber now waits for the results of a mental evaluation to determine if he, too, is fit to stand trial for the death of a beloved teacher.

A grand jury has charged Huber, 43, with murder in the first degree for his role in the death of Timothy Larson, 46. Police say Timothy Huber's father, Delbert Huber, shot Larson in October 2011.

A Kandiyohi County judge ordered a mental evaluation on Dec. 7, after Timothy Huber’s attorneys filed paperwork stating the man was either ill or under duress at the time of the shootings.

Forensic psychologist Dr. Edmund Nadolny filed the report with the court Tuesday, and it is not public information under the state's open records laws. Attorneys will have until next Friday to dispute any findings in the report.

Kandiyohi County Attorney Jenna Fischer told the Willmar Tribune she expects, and hopes, the younger Huber will be found competent to stand trial.

Under Minnesota court rules, a person who uses a mental illness defense is subject to an evaluation to determine competency in order to proceed with criminal charges.

The jury last November charged Timothy Huber, son of 81-year-old Delbert, with first-degree murder (by association). Delbert Huber also faces charges of premeditated murder after he was arrested in Kandiyohi County for pulling the trigger of his Enfield rifle and gunning an unarmed Larson down, according to the sheriff's department.

Police reports state Delbert Huber waited 12 hours before calling authorities about the shooting.

Timothy Huber drove the Delbert and himself to the Larson family farm outside of Willmar, where he was to perform chores for Timothy Larson's father, the report states.

In continues to say an argument about when and where those chores should be performed began Friday night when Timothy Larson arrived at his father's farm, and continued Saturday morning, ending in the shooting death of the teacher.

Timothy Huber, when first interviewed by authorities Saturday, Oct. 8, told officers and investigators Larson had fought his father, and then the shot was fired.

Sunday, Oct. 9, he was re-interviewed, and he changed his story, saying his father fired the shot after a verbal altercation, and that Larson had not been physical in the incident.

Both Huber men remain in custody in the Kandiyohi County Jail. Delbert Huber's bail is set at $5 milliion, Timothy Huber's at $1 million.
