Coin Toss Determines Sorensen Re-Elected to Albertville City Council

After a recount, a split council vote and a coin toss, Larry Sorensen was re-elected to the Albertville City Council Monday night.

It was the election that just wouldn't end — or so it seemed — Monday night at an Albertville City Council meeting.

A chance between heads or tails in a council coin toss declared incumbent Larry Sorensen as the winner of the race for city council. The question of who would fill the seat — Sorensen or candidate Mark Barthel — had been unanswered since the Nov. 6 elections.

The coin toss was, by law, the last procedure a council must do in a case like this one — a close election, a subsequent recount finding an exact tie, and lastly, a tie between city council members in determining who the vote was for in a challenged ballot.

After Thursday's recount results resulted in an exact tie between Sorensen and Barthel, Monday night's council meeting was to determine the voter intent on one challenged ballot.

With both men going into the meeting with 1,116 votes, the deciding factor was a ballot the election judges said counted for Sorensen that Barthel was challenging.

The vote on the ballot, as seen in the photo, was an oval that was not completely filled in. Instead, marks were made within the oval that would typically be completely filled in for a vote for Sorensen.

Albertville City Attorney Mike Couri explained in a memo to the council that they would need to determine voter intent and vote on whether they believed the vote was for Sorenson or not.

If the vote was decided for Sorensen, he would win the city council seat. If the vote was decided not for Sorensen, the council seat would remain a tie and a decision would be made by a coin toss.

"I thought it was just a pen mark," Barthel explained to the council as grounds for challenging the vote, noting that other votes on the ballot were filled completely in. However, some other offices were left blank.

"The intent was clear to me," Sorensen explained. "There was back and forth motion here."

Council members Dan Wagner and Jillian Hendrickson both agreed that they thought it was a vote for Sorensen. Mayor Mark Meehan and council member John Vetsch needed more time to discuss.

"The marks throughout the ballot aren't consistent," Vetsch said to the council.

When a motion was made to accept the vote for Sorensen, Wagner and Hendrickson voted yes and Meehan and Vetsch voted against the motion, making it a tie vote. Sorensen did not vote because it would be considered a conflict of interest, explained Couri.

"The ballot says to fill in the oval completely and this oval was not filled in completely," Meehan explained regarding his vote to not accept the vote for Sorensen.

"My read of the law is that if you are unable to determine voter intent, we go to a coin toss," Couri explained.

Meehan declared heads for Sorensen, tails for Barthel and city clerk Kim Olson flipped the coin.

It was heads, resulting in Sorensen being re-elected to council for four more years.

Clearly a vote for Sorensen based on the photo. Surpised it came down to a coin flip.

Mr. Sorensen deserved to win based on the ballot displayed... This seems like a railroad motion to get Sorensen off the city council. Mr. Sorensen should run for Mayor to rid Albertville from the travesty of a Mayor that they have today. Next onward and upward maybe even a run at the Senate. Senator Sorensen, has a nice ring to it.

This is where democracy fails our society. Someone's voice was not allowed to be heard - rather a group decision to disallow and force a non democratic process to occur. The decsion to not count that as a vote for Sorensen was a poor decision and a failure to that person who cast that vote!

It would appear that Mr. Vetch and Mr. Meehan were looking to exact some revenge on Mr. Sorenson for not "towing the line" in regards to the City Administrator fiasco that took place this spring, I think Mr. Vetch was trying to make sure he had a 3-2 majority on the council now that Ms. Hendrickson has been voted in as Mayor. It is a pretty sad state of affairs when 2 members of the council cannot let their petty differences go and vote honestly. Thankfully Mr. Meehan has reallized he is in over his head and decided not to run again.

Voter intent laws do not require a voter to fill in the complete oval nor do they require the voter to have uniform marks throughout their ballot. Even if a person were to circle the oval, place an X next to the candidate’s name, or circle the candidate’s name – these are all considered a vote. Our city attorney could find no cases similar to this example where the courts did not allow the vote. During the recount last Thursday, the election officials ruled that this was a vote. Each candidate at the recount can challenge any vote, and that is all good and fine, but when a canvassing board (in our case the city council) has to make the determination on a vote, they are given voter intent guidelines, statutes, and past court rulings. All these things tell us this is a vote. And if it had to go to a judge, I have no doubt that this would be ruled a vote. In any case, I am grateful that the coin landed the way it did, and I look forward to continuing to serve the people of Albertville. To those who voted for me, thank you. Your vote was the difference!

There will be an open seat when Hendrickson vacates hers to become Mayor. Narthel could run for that.
Additionally, I sincerely hope that Mr. Sorenson rethinks his comments about issuing bonds for "pet projects" this city cannot afford at this time. This is a city of 7,500 people, not some metropolis where bonding would be a financial option.

I appreciate that Larry. However, I think you realize where I'm coming from. This city is not big enough (monetarily) to start issuing bonds for pet projects. When asked about finacing issues during the debate, you said bonding is a viable option. I hear that and want to run for the hills. Bonding is financially prudent for infrastructure needs to be utilized by the entire populace. That means hockey rinks, community centers and the like can be privately financed. If the need is there, then the financial backing will be there. To put the city taxpayers on the hook is irresponsible.

Larry, not an accusation. Someone had asked the candidates about financing "projects" and bonding was looked on as an alternative by you. I had made the comment about public funds, i.e. my tax dollars going towards expanding the ice arena during the Mayoral debate. For the record, I'm 100% against this city issuing bonds for any pet project. We do not have the population nor tax base to support such an endeavor.

Rick - Thanks for your thoughts. I reviewed my comments from the City Council candidate forum (video is still on Patch) and I could not find any place where I say anything about bonding. Also, when I see my name mentioned in the same posting with words like "pet projects" and "irresponsible" it can be interpreted that I am a supporter of wasting taxpayer money for personal agenda items. All not true.

Larry, unfortunately, I cannot find the link to the debate which was taped. However the comment was made towards the end of the debate described above. I am glad you are on the record regarding your thoughts on how your constituents money is spent. I sincerely hope the other council members and our newly elected Mayor are on board as well. Thank you for your replies as well.

Any reasonable person who knows anything about what voter intent is would look at that ballot for about two seconds and call it a vote. I hope Meehan and Vetsch are proud of themselves for taking a voter's voice away and almost costing Sorensen the election. Sad and disgusting. At least Meehan got something right, declaring heads for Sorensen.

Larry, thanks for the link to the video. I stand corrected. I listened to your comments as well as others and did not hear a reference to bonding in them. So apparently my ears are playing tricks on me. However, that being said, I do appreciate the seriousness that the city council is taking in dealing with the current budget. And with current economic projections, in my opinion no city should be looking to engage in infrastructure projects that a: do not meet the entire needs of the populace and b: to keep the city running in it's current form with no reduction in staff if possible.
